Case Summary:
Based on a CEI conducted in June 2004 and a follow up
information request in June 2005 , CPR has a 2.5 acre site
that is routinely cleared of all vegetation and near a
waterbody. No storm water BMPs were in place to prevent the
runoff of erosion and sediment to Las Lajas Creek. CPR
claims that this is no construction activity because
it is routine maintenance that is conducted twice per year
to allow access to groundwater monitoring wells and for
security purposes. Nonetheless, CPRs Individual NPDES
Permit requires that the Storm Water Pollution Prevention
Plan contain sediment and erosion controls for the facility.
CPRs SWPPP did not contain any sediment and erosion
controls for this 2.5 acre site and therefore they are
violating the conditions of the Permit. This Order requires
CPR to modify its SWPPP and include storm water BMPs for
this 2.5 acre site.
